Copyrights and images

If you want to use a "non-free" image in the English Wikipedia, you can do so under certain narrow circumstances. Please read WP:Non-free content criteria for details. This Wikipedia policy has legal implications, so there is very little "room for interpretation."

It is debatable whether the image you wanted to use on Australian Financial Review‎ would meet all of the criteria outlined in Wikipedia's rules for non-free content, even if it would meet the legal requirements for "fair use" in the United States. In particular, I'm not sure that the image meets criteria 8, Contextual significance. Non-free content is used only if its presence would significantly increase readers' understanding of the article topic, and its omission would be detrimental to that understanding. Even if it does, criteria 3b, Minimal extent of use. An entire work is not used if a portion will suffice, would require an even lower resolution version - no wider than is needed for the infobox - and, arguably, cropping to just show the masthead and part of the page, not the whole page.

Images which do meet those criteria should be uploaded to the English Wikipedia, not to the Wikimedia Commons. Non-free content is pretty much "deleted on sight" on the Commons.

If you intend to add a version of that image back to the article, I recommend opening a discussion on the article's talk page first, specifically asking if the use of the image would meet criteria 8 of the non-free content criteria. davidwr/(talk)/(contribs) 15:40, 14 November 2020 (UTC)Reply
